First Amendment versus Littering

     A member of the United Northern and Southern Knights was issued a ticket for littering when he refused to pick up leaflets that he had been lawfully distributing in Rush County Indiana. He had the right to distribute paper that all members are ordered to carry with them when participating in this activity. This paper clearly shows that the Supreme Court in two different rulings determined that this activity is legal, a first amendment right and not to be interfered with. When the member tried to get the officers to read this paper they all refused saying they were not interested in what it said.

     The news media was then furnished and published the members name and address. As the Klan in some circles is considered to be a controversial organization and has had open threats against it, this is to us reckless endangerment. We are sure that not every person who litters in Rush County has their name and address published in public.

     Having considered the seriousness of this being a first amendment violation more than a littering charge we have retained an attorney to defend said member in court. We are also seeking legal advice to determine if we are going to pursue civil suits as well.

     The thing we find ironic in this is a few people stated this was "racist". What was being distributed was a flier glorifying Jesus Christ at Easter. Where is the "racism" in that?
